KUALA LUMPUR, May 27 — Vivian Lee May Ling was today sentenced to six months in prison after she was convicted of sedition over a mock greeting featuring the “bak kut teh” pork dish during the Muslim fasting month.
Sessions Court judge Abdul Rashid Daud said the matter involved the sensitivities of the Muslim community, and that he was imposing the prison term to deter others from doing the same.
“You know that pork is haram (forbidden) for Muslims.
“Like what the prosecutor said, nasi sudah jadi bubur, even if there was apology, but your actions have injured the feelings of Malaysians,” he said, using the Malay idiom that means “too late to make reparations”.
The judge said the six-month jail term, less the eight days Lee spent in lock-up from July 18 to July 25, 2013, was meted out as this was her first offence.
First-time convictions for sedition are punishable with a maximum RM5,000 fine or a maximum three-year jail term or both.
Immediately after the conviction today, lead counsel Chong Joo Tian sought a good behaviour bond for Lee, noting that the 27-year-old customer support services representative has no criminal record and had started a new life without the ex-boyfriend who was jointly accused over the same mock greeting on Facebook.
Chong also highlighted that she was not the main offender and merely played a passive role over the July 11, 2013 Facebook photo, adding that she had apologised on Facebook and removed the greeting the same day as well as apologised in a YouTube video the next day.
“This shows the accused’s regret in this case. Even though in this case there was evidence of public anger towards the posting, but the evidence shows there was no chaos at all or fights between races or people of different religions,” he argued.
Chong also pointed out that his client had not acted violently or caused physical injury to others, arguing that this was merely a case over an abuse of the constitutional right of freedom of expression and the wrong use of words.
But deputy public prosecutor Wan Shaharuddin Wan Ladin pressed for a jail sentence of between 20 and 24 months, arguing that there was a need for a “chilling effect” to deter other would-be offenders from mocking the religious beliefs of others in Malaysia.
Wan Shaharuddin cited public interest and argued that Lee’s actions had injured the feelings of both Muslims and non-Muslims in Malaysia, noting that online comments from many in the Chinese community showed they were upset as well.
“All Malaysians have the responsibility to respect the race and religion of others because it is appropriate social behaviour. It is not the prosecution’s intention to restrict Malaysians in the use of social media or Internet but there needs to be a standard to control an individual to be more responsible when uploading anything on social media,” he said.
He also said the offence was serious and argued the sentencing trend in the Malaysian courts was to impose imprisonment for sedition convictions, citing among others Sabah politician David Orok’s 18-month jail term after he pleaded guilty to a seditious insult of Prophet Muhammad.
“The court will be considered to have failed if it imposed a sentence based on compassion and sympathy on the accused,” he had argued.
After the sentencing, Abdul Rashid allowed the jail sentence to be stayed pending Lee’s appeal to the High Court, but increased the bail from RM10,000 to RM20,000 and ruled that her passport remain in the court’s possession.
Wan Shaharuddin told reporters later that he will also file an appeal to seek for a harsher sentence to be imposed.
The picture of Lee together with then boyfriend Alvin Tan Jye Yee, which was posted on Facebook on July 11, 2013 during the Muslim fasting month then, carried the words “Selamat Berbuka Puasa (with Bak Kut Teh...fragrant, delicious and appetising)” and the halal logo.
On July 18, 2013, Tan and Lee were charged under three laws: Section 5(1) of the Film Censorship Act, Section 4(1)(centre) of the Sedition Act and Section 298A(1) of the Penal Code.
But the Sessions Court had on April 14 acquitted Lee over the display of pornographic images on the duo’s now-defunct blog between July 6 and 7, 2013, while Tan — who did not attend trial — was given a discharge not amounting to acquittal.
The Court of Appeal had previously dropped the charge of Section 298A(1) against the duo as it ruled the legal provision did not apply to non-Muslims.
Under the Section 298A(1) charge, the duo were accused of uploading content that could possibly stir hostility among those with different beliefs between July 11 and 12.
Tan jumped bail and is believed to have fled to the United States to avoid facing trial.

News 8 Louisiana – Police are calling this a crime of the unthinkable, something that most people would never imagine doing. On Monday, police were called to a Louisiana Walmart under the suspicion that a customer was shoplifting food. According to the complaint, a Walmart worker radioed security about a suspicious woman in the meat aisle. Security cameras filmed 33-year-old Shaniqua Johnson shoving sausages under her shirt. CCTV footage then shows the woman walking to the bathroom, where she remained for at least 30 minutes.
The male security guard says he knocked on the bathroom door several times but the woman did not respond. He then announced he was entering. What he found behind the door of the unlocked stall is something he said will “haunt his dreams forever.” The security guard reports when he entered the stall, Johnson was inappropriately pleasing herself with a Jimmy Dean package of sausage. He said that when he entered “She didn’t even stop. She just stared at me and kept going.”
Shocked, and also frightened for his safety due to the fact that Johnson is a “big girl,” the 140 pound security guard said he ran out until police arrived. When they did, female officers entered the restroom with Johnson still “putting in work with the sausage.” All in all, it took 7 police officers to restrain Johnson and pry the victimized sausage out of the woman’s hands. She was arrested and taken into custody where she was charged with shoplifting, indecent exposure, and resisting arrest. Walmart management said in no way do they tolerate this type of behavior. They have a strict policy against shoplifters and a sign on the bathroom door that clearly reads, “No merchandise allowed beyond this point.”

Interpol is reportedly searching for Malaysian sex blogger Alvin Tan to get him to return to the country and face trial in court. Tan is believed to have gone to Singapore in May to shoot a documentary.
SINGAPORE: Interpol is searching for sex blogger Alvin Tan to get him to return to the country and face trial in court, according to reports in the Malaysian media.
The Star quoted Inspector General of Police Khalid Abu Bakar as saying that his officers were liaising with Interpol to bring the Malaysian citizen back and get him to surrender his passport. The Malaysian Insider meanwhile reported that according to his lawyer, Tan, 25, and his partner Vivian Lee May Ling, 24, went to Singapore to shoot a documentary in May - but added that he was unsure if Tan is still in the Republic.
The couple is facing charges under the Sedition Act and the Film Censorship Act, relating to their action in posting an insensitive Ramadan greeting on their Facebook page and pornographic photographs in their blogs.
In the first charge, they were jointly accused of making a seditious posting on their Facebook page by uploading a photo of themselves eating bak kut teh (a Chinese herbal pork soup) with a caption "Selamat Berbuka Puasa" - a Malay greeting when breaking fast.
Lee and Tan, a former law student at the National University of Singapore, had sparked outrage in Malaysia and Singapore by posting erotic photographs and videos of their lovemaking as well as close-ups of their genitals on a blog.
Tan's mother, Madam All Kim Lian, as well as another bailor, Loo Ching Ching, on Saturday forfeited the RM20,000 (S$7,900) bail imposed by the Sessions Court on Tan when he did not return his passport for a third time.

Tan - speaking to our correspondent via a personal Facebook account that Channel NewsAsia has verified belongs to the “sex blogger” - said on Wednesday (Sep 24): “I'm busy starting a new life here (in the US), apart from awaiting my final asylum hearing. I'm here to seek political refuge from the tyranny of UMNO - simple as that.”
Tan first applied for asylum-seeker status in May, after disappearing from the public eye following a documentary shoot in Singapore. He said he feels confident the US will grant him asylum - and if they do not, he claimed he will continue posting "seditious material" online to strengthen his case.
"The Department of State produced a Human Rights Report on Malaysia in 2013 which explicitly cites my case as a repression of internet speech rights," he said.
"If all else fails, I can easily publish more 'seditious' materials on my Facebook to taunt the authorities and get them to be hot on the pursuit of me again, therefore creating an even more well-founded fear of political persecution to bolster my asylum claim.”

The Malaysian Communications and Multimedia Commission says Tan's Facebook page violated the social media network's terms and conditions, and found his actions as "distasteful".
SINGAPORE: Malaysia's Internet regulator, the Malaysian Communications and Multimedia Commission (MCMC), requested Facebook to remove the page of Malaysian "sex blogger" Alvin Tan Jye Yee, claiming it is "against their terms and conditions of service".
On its Facebook page on Oct 1, MCMC Chairman Mohamed Sharil Mohamed Tarmizi wrote: "We condemn the irresponsible act of Alvin Tan on Facebook and find his actions distasteful. We have made a complaint to Facebook and have requested it to immediately remove the page as we believe it is also against the terms and conditions of service."
"We remind the public to refrain from sharing sensitive content which may offend others," he added.

Sex bloggers Alvin Tan and Vivian Lee succeeded in getting back their passports from the court today, pending a trial over their controversial Ramadan "greeting" last year, as they are scheduled to travel to Singapore for the filming of a programme on their life story.
Kuala Lumpur Sessions Court judge Abdul Rashid Daud allowed the two to have their passports back until June 3, based on an application by their lawyer Chong Joo Tian.
The prosecution led by deputy public prosecutor Wan Shaharuddin Wan Ladin did not object to the return of the passports, but asked that Tan and Lee, who are popularly known as “Alvivi”, not to comment on the pending case during the filming of the programme in Singapore.
Chong said later that the judge also waived a pre-set condition for them to report to the police station on June 1.
He said upon their return on June 3, they would have to return their passports to the court and would be required to continue reporting to the nearest police station at the beginning of each month.
Last month, the Court of Appeal struck out a charge under the Penal Code against the two sex bloggers on grounds that it was not applicable to non-Muslims.
The charge under Section 298 – for stirring hostility between religions – was struck out on the grounds that the law was meant to ensure the smoothness of the practice of Islam among its followers, not those of other religions.
However, Tan and Lee still face two other charges under the Film Censorship Act and Sedition Act for allegedly publishing a photograph with the comment "Selamat Berbuka Puasa (dengan bak kut teh... wangi, enak, menyelerakan)" which contained a halal logo and allegedly seditious statements, and for displaying pornographic images on their blog.
The duo's postings on July 11 last year triggered furious reactions from Malaysians of all races, following which they removed the posting and uploaded a new picture of them eating ketupat, rendang and curry puffs.
However, the Facebook page was later removed.
The trial date at the Sessions Court has yet to be fixed as the Attorney-General's Chambers is appealing against the Court of Appeal decision on Section 298 of the Penal Code.

A Brisbane father has been convicted of hiring an underage prostitute for his 13-year-old son on a family holiday to Thailand.
He is believed to be the first person charged under child sex tourism laws introduced in 2010 and aimed at stopping Australian pedophiles from exploiting foreign children.
The episode happened during a trip to the resort island of Koh Samui for a friend's wedding in September 2012, the Courier Mail.
The father, who cannot be named for legal reasons, got drunk at the buck's party and told his son he did not want him returning to Australia "without losing his virginity," the Brisbane District Court heard.
He then paid a prostitute, inspected the room to make sure there were condoms and waited downstairs while his son had sex.
He then told the boy not to tell his mother, who was holidaying with them in Koh Samui.
The mother did find out, however, and made a formal complaint to police after an "acrimonious" marriage split.
The father later pleaded guilty to procuring a child to engage in sex outside Australia.
Yesterday his defence barrister said his client realised his behaviour was wrong and a psychologist treating him for depression had concluded there was no risk of reoffending.
The father was sentenced to 12 months in jail but released on a $2000, two-year good behaviour bond.

SINGAPORE — A school teacher was today (March 31) charged with a slew of sexual offences involving a student.
The 32-year-old teacher faces 10 charges of various sexual offences involving the underage girl, which took place between September 2012 and January 2013.
According to court documents, he allegedly had sex with the girl eight times, as well as committing obscene acts with her twice.
The girl was 15 at the time.
The alleged acts took place at various locations, which included hotels.
The accused’s lawyer, Roy Neighbour, asked for the case to be adjourned for him to make representations.
The accused is out on bail of S$20,000 and will be back in court on April 28.
If convicted of having sex with an underage girl, he could be jailed for up to 10 years and fined on each charge.
For committing an obscene act with a child, he could be fined S$10,000 and jailed five years on each charge.

The 32-year-old teacher faces 10 charges of various sexual offences involving the underage girl, which took place between September 2012 and January 2013.
According to court documents, he allegedly had sex with the girl eight times, as well as committing obscene acts with her twice.
The girl was 15 at the time.
The alleged acts took place at various locations, which included hotels.
The accused’s lawyer, Roy Neighbour, asked for the case to be adjourned for him to make representations.
The accused is out on bail of S$20,000 and will be back in court on April 28.
If convicted of having sex with an underage girl, he could be jailed for up to 10 years and fined on each charge.
For committing an obscene act with a child, he could be fined S$10,000 and jailed five years on each charge.

One of Taiwan’s biggest sex scandals in recent years involving a rich playboy and several victims including models and starlets, has closed with a 22 year jail term for assaulting nine women and filming the acts
Taipei: Socialite Justin Lee, the son of former Yuanta CEO Lee Yueh-tsang, has received a jail sentence of some 22 years for sexually assaulting nine women and filming the acts.
A host of Taiwanese starlets and models had been named among Lee's victims.
According to Taiwan media, Lee who's also known as Li Zongrui, had 27.5GB files of sex videos and nude pictures found by police in his apartment.
A total of 93 videos (883mins) and 176 photos were apparently found on the hard-drive of Lee's computer and a few has since been leaked online.
The graphic images show Lee having sex with different women, some of whom appear dazed or struggling with him.
Lee who faced 45 counts of rape, aggravated rape, and violation of privacy, turned himself in last month after hiding from authorities.
The court chided Lee, saying "Lee should have collaborated with the authorities to clarify the case".
The Taipei district court went on to sentence Lee to jail for 18 years and six months for nine counts of assault.
He was sentenced to another three years and ten months for making sex videos without the women's consent and invading their privacy.
In addition, Lee will also have to pay a total of NT$14.25 million (S$610,200) in damages to 12 of his victims.
As previous hearings of the case were closed to the public, Taiwan media turned up in force for the sentencing of Lee, who appeared relieved when his sentence was read out.
The court said there was not enough evidence to convict Lee of aggravated sexual assault by drugging some victims, as prosecutors had requested.
The 28-year-old was originally accused of drugging, raping as well as secretly filming as many as 30 women, among them models and actresses – crimes which carry a combined maximum penalty of 30 years jail - in one of Taiwan’s biggest sex scandals in recent years.
Lee who plans to appeal the sentencing has claimed that all the women in the videos had agreed to the recordings. He has also denied drugging them.
In July 2011, two sisters filed a complaint against Lee for drug rape and recording sexual activity without consent.
Amidst a year-long police investigation, the scandal took another turn when Next Magazine claimed in August last year,that Taiwanese celebrities Maggie Wu, Terri Kwan, Bianca Bai, and Ruru Lin were featured in the videos.

KUALA LUMPUR: The High Court today set this Thursday to hear the application for leave for judicial review filed by controversial couple Alvin Tan and Vivian Lee over the Sessions Court judge’s decision to deny them bail.
The duo’s lawyer, Chong Joo Tian, told reporters that the application was filed on July 19 and would be heard by High Court Judge Mohd Azman Husin.
They were charged with three counts of mocking Muslims and the holy month of Ramadan and posting pornographic pictures on their blog.
The claimed that Judge Murtazadi Amran had erred in law by denying them bail as they had no prior criminal record.
Tan, 24, and Lee, 25, further claimed that there were no grounds for the prosecution’s submission that they had a tendency to commit the same offence if released on bail.
The couple submitted that all their electronic equipment and computers had been seized by the Malaysian Communication and Multimedia Commission (MCMC) and if there was a risk of repeating the offence the court could have set conditions for the bail.
Tan and Lee also said they did not pose a flight risk as their families lived in Malaysia and even if there was their passports could have been impounded.
On July 18, Judge Murtazadi denied Alvin Tan (Tan Jye Yee) and Vivian Lee (Lee May Ling) bail, pending their trial on the grounds that the case was a matter of public interest.
Tan is being detained at the Sungai Buloh Prison while Lee is in the Kajang Prison.
They were jointly accused of making a seditious posting on ‘Alvin and Vivian – Alvivi’ Facebook site (https://www.facebook.com/alvivi.swingers) with a photo of themselves eating ‘bak kut teh’ (a pork dish) with the greeting ‘Selamat Berbuka Puasa (Happy Breaking Fast) with bak kut teh, fragrant, delicious and appetising’, with a halal logo as well.
On the second charge, Tan and Lee were accused of posting pornographic pictures on http://alviviswingers.tumblr.com/ at the same place between 9pm and 2am from July 6 and 7.
The duo were also charged with posting on their own Facebookpages the same picture (bak kut teh picture) and comments which were likely to cause religious enmity between people of different faiths.
Deputy public prosecutor Noorin Badaruddin, who led the prosecution, had applied for both the accused to be denied bail as the charges they faced were under Section 298A (1) (a) of the Penal Code and Film Censorship Act, which were non-bailable offences.

Yesterday, the High Court allowed them to be out onbail of RM30,000 each, with two sureties, after they applied for a revision of the Sessions Court’s decision to deny them bail.
High Court judge Mohd Azman Husin set bail at RM10,000 on each of the three charges Tan and Lee are facing.

Soon after Alvin and Vivian Lee signed their release documents this morning, reporters rushed up to them and asked how it was like in prison and Alvin said with a smile, “Not bad.”
Vivian kept her head down and did not respond.
Chong Joo Tian, their counsel, said his clients were “quite happy to be out of prison”.
He added: “They need time to rest. We will take it from here.”
Alvin’s mother posted bail for both of them.

“I urge the public to help monitor the couple’s blog and social networking sites and report the same to the authorities,” he told reporters here today.
Commenting on their conditional release on bail yesterday, Jailani said stern action would be taken against the bloggers if they breached the court’s conditions.
Yesterday, High Court judge Datuk Mohd Azman Husin released them on RM30,000 bail in one surety each, with four conditions.
The conditions are, their passports are compounded, they must report to the nearest police station once a month, are prohibited from posting obscene photographs, provocative comments or articles which touch on religious and racial sensitivities, and prohibited from using network communication devices for the same purpose.

KUALA LUMPUR, July 18 — Sex bloggers Alvin Tan and Vivian Lee are now behind bars after they were denied bail when they pleaded not guilty to three charges at the Sessions Court here today.
Alvin Tan Jye Yee, 25, and Vivian Lee May Ling, 24, were sent to the Sungai Buloh and Kajang prisons respectively after their charges were read before judge Murtazadi Amran.
In the first charge, they were jointly accused of making a seditious posting on “Alvin and Vivian – Alvivi” Facebook (https://www.facebook.com/alvivi.swingers) by uploading a photo of themselves eating bak kut teh (a pork dish) with the greeting ‘Selamat Berbuka Puasa with bak kut teh …fragrant, delicious and appetising’ together with the ‘halal’ logo.
They allegedly committed the offence at 10.48pm between July 11 and 12 at 568-14-18, Kompleks Mutiara Jalan Ipoh, Mile 3 1/2 here.
They were charged under subsection 4 (1) (c) of the Sedition Act 1948 which is punishable under subsection 4 (1) of the same Act and read together with Section 34 of the Penal Code.
For the first offence, they face a fine up to RM5,000, an imprisonment up to three years or both.
In the second charge, Tan and Lee were accused of displaying pornographic pictures on http://alviviswingers.tumblr.com/ at the same place between 9pm and 2am between July 6 and 7.
They were charged under subsection 5 (1) of the Film Censorship Act 2002 which is punishable under subsection 5 (2) of the same Act which carries a fine of between RM10,000 and RM50,000 or imprisonment of up to five years or both, if convicted.
They were accused of uploading on their Facebook page the same picture and comment which were likely to cause religious enmity between people of different faiths.
The content was read at CAF – Syed Restaurant, Jalan Dang Wangi here at 10.48pm between July 11 and 12.
They were charged under Section 298A (1) (a) of the Penal Code which carries imprisonment of between two and five years, if convicted.
The couple looked unperturbed when the charges were read to them individually and they also responded individually by saying, “I asked to be tried”, Bernama reported.
Judge Murtazadi denied bail for both accused after taking public interest into account.
He said the court was not affected by external elements in deciding on the bail.
Earlier, Deputy Public Prosecutor Noorin Badaruddin asked the court not to grant bail to the accused as the charges under Section 298A (1) (a) of the Penal Code and the Film Censorship Act were non-bailable offences.
“Of course, we accept the court discretion to allow bail on the two charges, but the prosecution objects to any bail granted until the trial is over,” he said.
Noorin said secondly, both accused had a tendency to upload pictures that could arouse public outrage.
Chong Joo Tian, the lawyer representing both accused, applied for bail for both of them on the grounds that the charges had yet to be proven and was premature in nature.
He said the prosecution could not pre-empt that the accused had a tendency to commit similar offences as they had yet to be found guilty.
“Both my clients gave full cooperation to the MCMC (Malaysian Communications and Multimedia Commission) and the police during investigations and they do not have any criminal record and the offence they were accused of do not involve any form of violence,” he said.
On the other hand, Deputy public prosecutor Ishak Mohd Yusoff argued that the court should take the surrounding circumstances into account in determining whether bail could be granted.
“Alvin Tan is a household name and if we were to ‘Google’ only the name Alvin, pictures and articles about him will pop up, for which, if it is not controlled, it can destroy society and religion. No doubt it does not involve violence, but it is a serious offence,” he said.
Noorin asked for the three cases to be tried together under Section 170 of the Criminal Procedure Code as they entailed the same transaction and witnesses.
However, Chong asked for the second charge to be tried separately as the first and third charges involved posting pornographic pictures on different websites.
Noorin said Section 170 allowed criminal offences to be tried together even though all the three cases were different and the prosecution would prove the offences occurred in the same transaction.
Murtazadi allowed the three cases to be tried together and set Aug 23 for mention.
He also gave an opportunity to the two accused to state their reasons why bail should be granted to them.
Tan said, “I want bail. I do not have any power, position, wealth, employment or job. And all my multimedia items have been confiscated by the MCMC which would affect my tendency to upload photos and access the Internet.”
Lee, who is a kindergarten teacher, said: “I would also like to be given bail and I have the same opinion as Alvin.”

“Of course, we accept the court discretion to allow bail on the two charges, but the prosecution objects to any bail granted until the trial is over,” he said.
Noorin said secondly, both accused had a tendency to upload pictures that could arouse public outrage.
Chong Joo Tian, the lawyer representing both accused, applied for bail for both of them on the grounds that the charges had yet to be proven and was premature in nature.
He said the prosecution could not pre-empt that the accused had a tendency to commit similar offences as they had yet to be found guilty.
“Both my clients gave full cooperation to the MCMC (Malaysian Communications and Multimedia Commission) and the police during investigations and they do not have any criminal record and the offence they were accused of do not involve any form of violence,” he said.
On the other hand, Deputy public prosecutor Ishak Mohd Yusoff argued that the court should take the surrounding circumstances into account in determining whether bail could be granted.
“Alvin Tan is a household name and if we were to ‘Google’ only the name Alvin, pictures and articles about him will pop up, for which, if it is not controlled, it can destroy society and religion. No doubt it does not involve violence, but it is a serious offence,” he said.
Noorin asked for the three cases to be tried together under Section 170 of the Criminal Procedure Code as they entailed the same transaction and witnesses.
However, Chong asked for the second charge to be tried separately as the first and third charges involved posting pornographic pictures on different websites.
Noorin said Section 170 allowed criminal offences to be tried together even though all the three cases were different and the prosecution would prove the offences occurred in the same transaction.
Murtazadi allowed the three cases to be tried together and set Aug 23 for mention.
He also gave an opportunity to the two accused to state their reasons why bail should be granted to them.
Tan said, “I want bail. I do not have any power, position, wealth, employment or job. And all my multimedia items have been confiscated by the MCMC which would affect my tendency to upload photos and access the Internet.”
Lee, who is a kindergarten teacher, said: “I would also like to be given bail and I have the same opinion as Alvin.”

PETALING JAYA – Sex bloggers Alvin Tan and Vivian Lee are again in the spotlight for the wrong reason.
This time, instead of posting videos of them having sex they posted a Selamat Berbuka Puasa message on their joint Facebook page.
But the message was posted along with a photo of them eating bak kut teh (a kind of herbal pork stew) and described it as “wangi, enak, menyelerakan” (fragrant, delicious, appetising).
Alvin Tan confirmed that they posted the greeting when The Star contacted them.
He said it was for “no reason. Just a joke, I guess”.
When asked if he regretted posting it, Tan said “not yet…”.
“Yeah, in a way. I don’t know. I was just curious to see how people will perceive it. It seems not everybody is on the same page as us. It is dark humour. It is just our attempt to see how it will be perceived. It is just trying to be humorous on the matter,” he said in a phone interview with The Star Online.
To him, the unfavourable response shows that “people don’t see the humour, people are mostly angry and upset”.
As to whether he will delete the posting, Tan said he would probably take it down, but “by now, many have shared the picture.”
The post received hundreds of comments mostly slamming the couple for their insensivity.

Malaysia's infamous sex blogging couple on Thursday pleaded not guilty in the district court for posting insensitive Ramadan comments on their Facebook page and pornographic pictures in their blogs.
KUALA LUMPUR: Malaysia's infamous sex blogging couple on Thursday pleaded not guilty in the district court in Kuala Lumpur to three charges related to their action in posting their insensitive Ramadan greeting on their Facebook page and pornographic pictures in their blogs.
The charges against Alvin Tan Jye Yee, 25, and Vivian Lee May Ling, 24, were read before Judge Murtazadi Amran.
The couple were denied bail and will be jailed pending trial, said a court official. The next court date has been set for August 23.
Sedition is punishable by up to three years in jail.
In the first charge, they were jointly accused of making a seditious posting on their Facebook page by uploading a photo of themselves eating bak kut teh (a Chinese herbal pork soup) with a caption "Selamat Berbuka Puasa" - a Malay greeting for breaking fast.
They allegedly committed the offence at 10.48pm between July 11 and 12.
They were charged under subsection 4(1)(c) of the Sedition Act 1948 which is punishable under subsection 4(1) of the same Act and read together with Section 34 of the Penal Code.
For the first offence, they face a fine up to RM5,000, an imprisonment up to three years or both, and imprisonment up to five years for subsequent offence.
The couple later apologised in a video on YouTube for the posting, which sparked widespread anger. Their Facebook page is no longer accessible.
Prime Minister Najib Razak criticised the couple on Wednesday while discussing implementing a new law to replace the colonial-era sedition act, which has been slammed by critics as a tool to crack down on dissent.
"The insolent and impudent act by the young couple who insulted Islam showed that freedom of expression and irresponsible opinion can jeopardise the community," he was quoted by The Star as saying.
Last year Lee, a kindergarten teacher, and Tan, who is currently unemployed and a former law student at the National University of Singapore, sparked outrage in Malaysia and Singapore by posting erotic photographs and videos of their lovemaking as well as close-ups of their genitals on a blog.
The duo, who said they aimed to destigmatise sex, shut down the blog because of family pressure in the conservative countries, where pornography is illegal.

A 23-year-old man has been sentenced to 12 months' jail for having consensual sex with a 13-year-old girl.

Former product executive Jordan Lee Han Sen had befriended the secondary school student on social networking site Facebook and on Twitter.
The two later exchanged mobile numbers and Lee also found out the girl's age.
In January this year, the victim ran away from home after her teacher told her mother about a love bite on the girl's neck.
Afraid of being scolded by her mother, the girl turned to the accused.
The pair returned to Lee's residence and had sexual intercourse.
Lee also admitted to another similar charge but that was taken into consideration for sentencing purposes.
In mitigation, Lee's lawyer Amolat Singh said the offences were born out of "chance encounters" and his client did not set out to take advantage of the girl.
Mr Singh added that this is Lee's first brush with the law and was genuinely remorseful for his folly.
Lee could have been jailed up to 10 years and fined for having sex with someone under 16 years.
